2. Scope and order of precedence
These terms apply to all quotes, bookings and assignments unless we have agreed otherwise in writing. Your own terms of purchase do not apply unless we have accepted them in writing.
If documents conflict, they take precedence in this order:
- A written agreement or booking confirmation for the specific assignment.
- Mandatory rules of law, including the CMR Convention.
- NSAB 2015 (see section 5).
- These terms.
3. Using this website
The information on futurecargo.dk is general and may change without notice. We work to keep it accurate, but we do not guarantee that it is complete or up to date, and it does not form an offer.
The text, logos, images and design on the website belong to Future Cargo Group or our licensors. You may not copy or reuse them for commercial purposes without our written permission.
You may not misuse the website, for example by trying to gain unauthorised access, spreading malware or sending automated requests through our forms.
The website may link to other websites. We are not responsible for their content or their handling of personal data.
4. Quotes and bookings
- Sending a quote request through the website does not create an agreement.
- Our quotes are based on the information you give us, including the type of goods, weight, volume, number of pallets, temperature requirements, addresses and dates.
- Unless otherwise stated, a quote is valid for 14 days and prices are in DKK or EUR excluding VAT.
- We may adjust the price if the information was incorrect or incomplete, if the goods or the assignment differ from what was quoted, or for extra costs such as waiting time, extra stops, changed routes, or ferry, toll and fuel surcharges outside our control.
- A booking is binding when we have confirmed it in writing, including by email.
5. Conditions that govern our assignments
All assignments are carried out under NSAB 2015, the General Conditions of the Nordic Association of Freight Forwarders, as they apply at any time. We send a copy on request.
When we act as carrier in road transport, the CMR Convention applies as implemented in Danish law by the Act on Contracts for the International Carriage of Goods by Road (CMR-loven). In Denmark, the Act also applies to domestic road transport. Where mandatory rules apply, they take precedence over NSAB 2015 and these terms.
6. Liability and insurance
Our liability for loss of, damage to or delay of goods is limited as set out in the CMR Convention and NSAB 2015. Under the CMR Convention, compensation for loss or damage is limited to 8.33 SDR (Special Drawing Rights) per kilogram of gross weight. Compensation for delay is limited to the freight charge.
We are not liable for indirect loss, such as lost profit, lost production, loss of market or claims from third parties, unless mandatory law states otherwise.
We do not take out cargo insurance on your behalf unless we have agreed this in writing. We recommend that you insure your goods for their full value.
7. Your responsibilities
- Give us correct and complete information about the goods, including their nature, weight, measurements, value and any special handling requirements.
- Pack, secure and label the goods so they can withstand normal transport.
- Provide the documents needed for the transport, such as commercial invoices, customs documents and health or veterinary certificates.
- Declare dangerous goods in writing before booking and in line with the ADR regulations. We only carry dangerous goods by prior written agreement.
- Make sure the goods may legally be transported and comply with applicable rules, including food safety rules.
You are liable for loss, costs and fines caused by incorrect or missing information, inadequate packaging or missing documents.
8. Temperature-controlled and food transport
- State the required temperature range in writing when you book. The temperature in our booking confirmation is the one we transport at.
- Goods must be pre-cooled or pre-frozen to the required temperature before loading. We may refuse or note goods that are outside the agreed range at loading.
- We keep the agreed set temperature during transport and can provide temperature records on request.
- We are not liable for deterioration caused by the nature of the goods, insufficient pre-cooling, inadequate packaging, or delays caused by you, the sender or the receiver.
9. Loading, delivery and waiting time
You must make sure the goods are ready at the agreed time and that our vehicles have safe access for loading and unloading. If loading or unloading takes longer than the free time stated in the quote, we may charge waiting time. If delivery cannot be completed for reasons we are not responsible for, you pay the extra costs, such as storage and new delivery attempts.
10. Prices and payment
- Unless otherwise agreed, invoices are due 8 days net from the invoice date.
- If you pay late, we charge interest under the Danish Interest Act (renteloven) and the compensation fee under section 9b of that Act.
- You may not set off claims against our invoices unless we have agreed to it in writing.
- As security for amounts due, we have a lien on goods and documents in our possession, as set out in NSAB 2015.
11. Claims
Report loss, damage or delay in writing to info@futurecargo.dk as soon as possible:
- Visible loss or damage: note it on the consignment note or proof of delivery when the goods are delivered.
- Hidden loss or damage: report it within 7 days of delivery, not counting Sundays and public holidays.
- Delay: report it within 21 days from when the goods were made available to the receiver.
Include photos, the consignment note and documentation of the loss. Claims under the CMR Convention are time-barred after one year, or three years in case of wilful misconduct.
12. Force majeure
We are not liable for failure or delay caused by circumstances beyond our reasonable control. This includes war, strikes and lockouts, extreme weather, closed roads or borders, cancelled ferries, pandemics, cyberattacks and actions by public authorities. This applies within the limits of mandatory transport law.
13. Personal data
We process personal data in line with our Privacy Policy.
14. Changes to these terms
We may update these terms. The version in force when we confirm your booking applies to that assignment.
15. Governing law and disputes
These terms and all assignments are governed by Danish law, excluding its conflict of law rules. Disputes go to the District Court of Esbjerg (Retten i Esbjerg) as the first instance, unless mandatory rules, such as article 31 of the CMR Convention, give a different venue.
